In April of last year, Michael "Crazy Mike" Gaboff, a pro stuntman, performed a stunt for the DVD release of Ghost Rider: Spirit of Vengeance. He was to jump a motorcycle off of a ramp, while lit on fire, and then land safely in water. One big problem, the stunt went terribly wrong, Gaboff overshot the lake and made a hard landing on the ground, which caused "a broken lower back, pelvis, neck, both arms, ribs, collar bone, and collapsed lungs." Making it worse, he was on fire, and since he didn't land in the lake, which would've extinguished the flame, he incurred second-degree burns.

TMZ has learned that "Crazy Mike" filed a lawsuit on Friday against the companies in charge of the film; Sony Pictures, Break Point Media and Next Point Inc..

In the lawsuit, Mike says the movie's "negligence" is to blame for his near-death experience -- claiming the film knew the move posed a HUGE risk and yet it "consciously chose not to take specific safety measures."

Not only that, Mike says production-honchos were WARNED not to go through with the "ultrahazardous activities," but chose to risk it "despite requests not to do so."

Mike's suing for medical expenses and loss of earnings -- he doesn't specify a dollar amount -- but he reportedly spent two months in a hospital recovering, with bills over $1 million.

NICOLAS CAGE returns as Johnny Blaze in Ghost Rider™ Spirit of Vengeance. At first Johnny is reluctant to embrace the power of the Ghost Rider, but it is the only way to protect the boy and possibly rid himself of his curse forever.

It's really sad that anyone should be seriously hurt promoting such a poor film.

They should have been sued for making the movie in the first place.
NeoBaggins - 3/9/2013, 6:54 PM
Not really understanding the negligence claim here, but I'm sure when you join a shit production, a number of unfortunate things are possible.

Use your own instincts.
DrainBamage - 3/9/2013, 6:56 PM
I fail to see how this is Sony's fault. The end decision to do the stunt was his. As they say, nobody put a gun to his head.
jessepostal - 3/9/2013, 7:00 PM
Than why did u do the stunt?
localman22 - 3/9/2013, 7:04 PM
There is a simple legal principle called "assumption of risk." where you know something is dangerous and decide to do it anyway. He knew the power of the motorcycle, he could see the length of the pond, and he was, supposedly, a professional. If he had doubts, he should have not made the jump or purchased insurance.
13echo - 3/9/2013, 7:08 PM
They knew he was "crazy" when they hired him.
Chloefornication - 3/9/2013, 7:10 PM
Pay the man. He deserves it.
sameoldthing - 3/9/2013, 7:15 PM
He should sell his soul to the demon Zarathos & become an all new Ghost Rider..then exact his revenge on those who wronged him!
Gulon180 - 3/9/2013, 7:21 PM
he just needs to walk it off
ComicFan1134 - 3/9/2013, 7:28 PM
@localman22-Exactly.
Enterlion - 3/9/2013, 7:44 PM
Hey!!!!! I know Crazy Mike! That jump just about killed him. He's really good friends with my best friend, who goes by The Horse. He was on Numbnuts on MTV and America's Got Talent. Hell, poor guy is still walking with a cane last I saw him.
Enterlion - 3/9/2013, 7:48 PM
Also, he did this way back in the summer of last year, that should give you a am idea of how long he's been recovering. He broke almost every bone in his body.
nach1wan - 3/9/2013, 7:50 PM
@sameoldthing that would be a good ghost rider film xD
indigobolt956 - 3/9/2013, 7:51 PM
why youd risk injury to promote such a piece of shit movie?? Is beyond me
MartiniShark - 3/9/2013, 7:58 PM
How did this "go wrong" exactly? In the films Johnny Blaze is known for crashing his jumps. Seems right in line with the content.

AsianVersionOfET - 3/9/2013, 8:20 PM
Everyone involved with this deserves to be injured. Hopefully this is the first of many accidents to come. Best news all week (besides Interstellar's release date)
CaptainObvious - 3/9/2013, 8:30 PM
I think this accident is a metaphor for the movie itself. A horrible wreck that crashes and burns, destroying everything, and costing a studio alot of money.
Jollem - 3/9/2013, 8:32 PM
if you play with fire...?
DioFoRio - 3/9/2013, 8:37 PM
lol! Dumb ass
AmericanPsychoWolf - 3/9/2013, 8:38 PM
If I was apart of that movie, I sue too!
Mercwitham0uth - 3/9/2013, 8:39 PM
I bet while he was in the hospital they showed him the movie. That's why he's suing.
TheDesertGorilla - 3/9/2013, 8:42 PM
LOL that made me laugh
angus666 - 3/9/2013, 8:54 PM
What safety measures could've prevented him from overshooting a lake?
SuspenseSmith - 3/9/2013, 8:55 PM
It's a sign that that movie is shit.
Jollem - 3/9/2013, 8:59 PM

KalElKent - 3/9/2013, 9:02 PM
marvel movies suck -_-
Blitzed - 3/9/2013, 9:05 PM
He had no say in wether or not he took the jump? Did rly he agree to the risk by going through with it? He should've had stunt insurance as well.
Jollem - 3/9/2013, 9:10 PM
Jimdlux - 3/9/2013, 9:23 PM
It's his own fault. Any stuntman with half a brain knows not to do a stunt they don't trust. In his own statement, "the movie's "negligence" is to blame for his near-death experience -- claiming the film knew the move posed a HUGE risk and yet it "consciously chose not to take specific safety measures" and then, "production-honchos were WARNED not to go through with the "ultrahazardous activities". Sony sucks, but I hope they win.
holeymonkey - 3/9/2013, 9:28 PM
Yeah....if the idea was to land in the lake, why hit the ramp so damn fast? He could of ran off the end of that ramp and hit water..... douche. LMFAO
AlexTheKaiser - 3/9/2013, 9:38 PM
@yossarian Agreed, I wouldn't be surprised if he failed un purpose just so he could get the chance to sue them
Brady1138 - 3/9/2013, 9:40 PM
So a professional motorcyclist, who should inherently know the risks ahead of time, sues a company for his negligence and claims instead they were the negligent ones?

I'm losing faith in humanity.
holeymonkey - 3/9/2013, 10:07 PM
Lost mine ages ago.

AHAHAHAAHAHAHAHAHAHAHAHAHAHAHAHAHAHAHAAHAHAHAHAHA
LordOfTheZegaRealm - 3/10/2013, 1:08 AM
Damn, first Sony doesn't make money off of the movie then they get sued by this guy. They should of made him sign a release.
ALegendaryPanda - 3/10/2013, 1:13 AM
OH SHIT HAHAHAHAHAHAHA!!!
Jollem - 3/10/2013, 1:14 AM
@LordOfTheZegaRealm - the movie was actually very profitable
YipCha - 3/10/2013, 1:27 AM
I don't care how cool it is to hate on this movie. I still really enjoyed it. It was a fun popcorn film. =)
Scabsallover - 3/10/2013, 1:45 AM
I too really liked this movie Yipcha. It was a very welcome change of pace in the superhero genre.
yingyangpalms - 3/10/2013, 3:10 AM
Why did someone at Sony think the stunt would promote the film? I cant imagine someone watching the stunt and then wanting to watch the film.

Its more like a stunt for a Jackass movie starring a Jackass Stuntman who really sucked at stunts.
NovaCorpsfan - 3/10/2013, 4:24 AM
Kevin Feige:Psst, stunt guy, c'mere.
Stunt guy:Yeah?
Kevin Feige: Here's the deal...
Ceejay - 3/10/2013, 4:35 AM
@Jollem - It wasn't profitable at all, it cost $57 million to make but made back $51 million domestically. The sad reality is that it took 80 days to make that so the ticket split results are in the favour of the theatres, the studio probably only got 50-60% of that $51 million, I'd say $30 million max if I was generous.

Same with Internationally, lord knows what it cost to market that piece of shit movie but it got a full release in 49 countries and only made $80 million. Basic international marketing cost about $40 million so that's half gone already. Add to that the ticket split ratio with the theatres again and the studio is lucky to get even $25 million from that $80 mill.

Then they have to pay out on royalties and the interest that incurs in the time doing so. That takes the movie further in the red if it isn't already a big hit which is what they gambled on.

So this dumb stunt is only going to cost them further if they lose the case. Doubt they will tho, this guy almost doesn't have a leg to stand on..ha ha, get it?
Shadowelfz - 3/10/2013, 5:01 AM
What a fricken baby. Its his job to do something risky, and he fricks up and sues his employers for his own failure to deliver? Of course its dangerous your a fricken daredevil!
