There have been many people questioning Spider-Man's attitude in the car thief clip. Some feel he is being too mean spirited, whilst others believe this is Spidey's trademark personality. Marc Webb explains the scene to MTV, here is what he had to say:

MTV: Judging from trailers and the few scenes that have been released online, the takeaway for me is that this is a grittier "Spider-Man" movie, a bit more dangerous than some of the more cartoony takes we've seen previously. But the prankster side is still in place too. There's a clip online of Peter really toying with a guy as he's webbing him up, so the comedy is definitely there. How did you find the right mix of comedy and darkness in this movie?

Webb: I wouldn't say we were ever after pursuing darkness. We just wanted to keep things real. I think it comes down to everything having to emerge from a real place. The reason why Spider-Man is being so playful in that moment is that as a character, he's feeling drunk on his power. He's having a really good time. He's becoming a bit of a bully there. He's not being deeply altruistic, and that's something you'll learn more about when you see the movie. It's a reflection of his attitude: He puts that mask on and the shy kid is gone. He's now this really empowered superhero. That means having fun, sometimes at other people's expense.

This looks like it is tying in with my theory on Uncle Ben's death and Peter learning the responsibility lesson:

I like it. Kind of makes me think of Chronicle (which was fantastic), except Peter will learn the error of his ways and become a better hero.

I always saw Spider-man use his anonymity as a reason to show the outgoing personality that he doesn't present in his real life. He lets loose in private because he would hurt others in public, that may be a lesson that he learns in this movie about his responsibility.

@StephenovDimitri4 Regarding that scene with the cops, Spider-man was in the middle of rescuing people from a fire. It was either let the vigilante do his thing or let the potential people still trapped burn.

TASM is the underdog this year and is severally over shadowed by the avengers, just wait till the movie comes out and we'll all forget about the avengers...

Sounds like Webb really knows what he's doing.

Sure, it was always "he quips to hide his fear". Now is "he quips cause he's drunk with power"... ¬¬

Obviously answering a question because he was asked about the clip, Spider-man obviously making jokes with uncle ben's killer because he doesn't immediately recognize the thief as ben's killer and obviously Spider-man quips because "he's drunk with power" since it's probably his first time being out in full suit. He has yet to learn responsibility, he's angry and it's only until he has to make the decision of either killing ben's murderer or turning him into the police. Obviously obvious.

@ Marvel87 It's not confirmed but it's a good guess that it Uncle Ben's killer.

Look at this set image:

http://www.internapse.com/gallery/var/albums/marvel/spiderman/movies/2012/filming/99.jpg?m=1314025632

And if you want, watch this set video:

Peter never gets a good look at the thief, but Uncle ben's death occurs almost right after that scene, so he can probably put two and two together and guess that's the guy he let get away. Peter also has the killer's wanted picture in his room. So what I was trying to say was that, in the car thief scene, Peter probably just thinks the guy is a petty car thief at first, until he gets a closer look realizes he looks familiar...

Now look at this image if you want further details:

http://www.redcarpetcrash.com/wp-content/uploads/2011/12/Empire-Preview-02.jpg

Could this be the moment when he finally realizes it's the same guy in the wanted poster? aka: uncle ben's killer
What would he have done if the cop didn't show up? Now of course, we also know Spider-man eventually captures the killer and gives him a web wedgie in front of the police building.

So no, I'm not saying he is sadistic, I think he was just angry that his uncle was killed and just decided to take it out who he thought was a random car thief. BUT WHO KNOWS? This scene might actually take place before Uncle Ben dies!
